The Employees’ State Insurance (ESI) Scheme is a social security system designed to provide financial and medical protection to employees in case of illness, injury, maternity, or other employment-related risks.

ESI registration is mandatory for eligible factories and establishments under the Employees’ State Insurance Act.

What is a Factory under the ESI Act?

Under the ESI Act, a factory refers to any premises where:

  • 10 or more employees are working or were working on wages on any day in the last 12 months, and

This definition also includes all departments within the same premises if they are connected to the manufacturing activity.

Additional Coverage Rules

  • Seasonal factories operating for up to 7 months (such as tea or coffee processing units) are also covered

  • Mines governed under the Mines Act and railway running sheds are excluded from ESI coverage

In simple terms, if a manufacturing unit employs 10 or more workers, it generally falls under ESI applicability.


What is an Establishment under the ESI Act?

An establishment refers to any organised workplace such as a shop, office, or service unit where employees work.

An establishment must register under ESI if:

  • It employs 20 or more employees, and

  • Employees earn wages up to the prescribed limit

Included Establishments

The term “shop” under ESI is interpreted broadly and includes:

  • Retail and commercial shops

  • Consultancy firms

  • Advertising agencies

  • Real estate service providers

  • Liaison offices and service-based businesses

The key factor is that the establishment is engaged in commercial activity or service delivery.

Excluded Establishments

Some institutions are generally excluded, such as:

  • Certain educational institutions

  • Hospitals and dispensaries (in specific cases)

  • Offices of professionals like auditors and chartered accountants (as per conditions)


Employees Counted for ESI Coverage

While determining ESI applicability, the following categories are included:

  • Employees on payroll (including those on paid or unpaid leave)

  • Temporary or substitute workers

  • Employees hired through contractors working under supervision

  • Directors receiving salary from the company

  • Employees earning above wage limits but otherwise covered

Not Included

  • Apprentices under approved training programs
