The Employees’ State Insurance (ESI) Scheme is a social security system designed to provide financial and medical protection to employees in case of illness, injury, maternity, or other employment-related risks.
ESI registration is mandatory for eligible factories and establishments under the Employees’ State Insurance Act.

Under the ESI Act, a factory refers to any premises where:
10 or more employees are working or were working on wages on any day in the last 12 months, and

Seasonal factories operating for up to 7 months (such as tea or coffee processing units) are also covered
Mines governed under the Mines Act and railway running sheds are excluded from ESI coverage
In simple terms, if a manufacturing unit employs 10 or more workers, it generally falls under ESI applicability.
An establishment refers to any organised workplace such as a shop, office, or service unit where employees work.
An establishment must register under ESI if:
It employs 20 or more employees, and
Employees earn wages up to the prescribed limit
The term “shop” under ESI is interpreted broadly and includes:

Consultancy firms
Advertising agencies
Real estate service providers
Liaison offices and service-based businesses
The key factor is that the establishment is engaged in commercial activity or service delivery.
Some institutions are generally excluded, such as:
Certain educational institutions
Hospitals and dispensaries (in specific cases)
Offices of professionals like auditors and chartered accountants (as per conditions)
While determining ESI applicability, the following categories are included:
Employees on payroll (including those on paid or unpaid leave)
Temporary or substitute workers
Employees hired through contractors working under supervision
Directors receiving salary from the company
Employees earning above wage limits but otherwise covered
Apprentices under approved training programs
ESI provides strong social security benefits to employees and their families:
Full medical treatment for insured employees and dependents
No upper limit on treatment expenses
Continued medical care for retired or disabled employees (on nominal contribution)
Cash compensation of around 70% of wages during illness
Payable for up to 91 days in a year
Extended benefits available for long-term or serious illnesses
Full wage compensation during maternity leave
Generally available for up to 3 months, extendable on medical advice
90% of wages paid during temporary or permanent disability
Based on medical assessment of loss of earning capacity
Monthly pension support (around 90% of wages) to dependents in case of death due to employment injury
